Social Media Platforms and other Links from and to the Site

  1. The Site may include links to social media platforms including without limitation Facebook, Twitter, Youtube and Instagram (“Social Media Platforms”). As part of the Services Available on the Site and your use generally of the Site, you may follow a link to Social Media Platforms from the Site, you may share the Site link or a link to certain parts of the Site on Social Media Platforms, you may upload to the Site photographs or other content which are already stored on Social Media Platforms (provided always such photographs and/ or content are owned by you), you may identify third parties on the Site by reference to their identities on Social Media Platforms (provided always the consent of those third parties has been obtained by you) or you may interact between the Site and Social Media Platforms in any other permitted way. Burgoyne does not author, edit, or monitor these Linked Sites. You acknowledge and agree that Burgoyne is not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on such Linked Sites.
  3. The applicant (the person submitting the story) should be above 18 years of age as on May 1, 2017. In most cases, the story should be of one’s own self but if the applicant is submitting the story of a known/ friend/relative, the story should be accompanied by a letter of authorization allowing the applicant to represent the story on behalf of the person whose story is being submitted.
  4. The story will have to be of a natural born male or female.
  5. Applicants are strongly advised to furnish only correct information. Any false information given by an applicant at any stage will lead to automatic disqualification.
  6. Burgoyne shall have the right to use photographs uploaded/submitted by the applicants on any platform – print or digital (web and mobile) – without any restrictions, worldwide and for perpetuity. The same material may also be used on any third-party platforms with which Burgoyne has an understanding. The applicant will have no claims against Burgoyne in this respect.
  7. The decision with respect to selection / non-selection of an applicant as a participant in the campaign shall be decided by Burgoyne in its sole discretion. Mere registration as an applicant does not entitle participation in the campaign.
  8. In the event, an applicant is chosen to participate and gets featured on the website. Failure/refusal to agree to the terms and conditions shall automatically disqualify an applicant from participation. It is clarified that such terms and conditions shall be in addition to these rules.
  9. We make certain services available to visitors of the Site. On the Site generally, you may be able to read information about the fashion tour, view films, tell your own style statements, upload your own photographs or other content, identify third parties in your story, photographs or other content, enter competitions, send branded material to friends etc (“Services” and the Services form part of the definition of “Site”).
  10. We do not solicit nor do we wish to receive any confidential or secret information or material from you through the Site, through any of the Services, by email or in any other way. Any information or material submitted by you will be deemed not to be confidential or secret.
  11. Visitors are solely responsible for any information or materials submitted by you through the Site, whether names, personal information, photographs, films, stories, music, ideas, creative concepts, other materials, information or data of any kind and in any format and other content you post on and through the Site (“User Information”).
  12. By submitting User Information to the Site you represent and warrant that the User Information is original to you and that no other party has any rights to it or that you have obtained all required consents and permits to enable you to submit the User Information to the Site and for it to appear on the Site. You also warrant that any “moral rights” in posted materials have been irrevocably waived in favour of Burgoyne.

Users should be aware that when they voluntarily disclose personal information (e.g., username, e-mail address, phone number) on or through the public portions of the Site (e.g., comments, photos), that such information is generally accessible to and may be collected and used by others and may result in unsolicited messages from other people. Visitors to and users of the Site are encouraged to exercise caution when providing personal information.

Except as otherwise provided herein, use of the Site does not grant to you a licence to any content, features or materials you may access on the Site. Any commercial use of the Site is strictly prohibited, except as allowed herein or otherwise approved by us in advance in writing. You may not download or save a copy of any of the content or screens for any purpose except as otherwise provided in these Terms and Conditions or as permitted on the Site. You may, however, print one (1) copy of the information on the Site solely for your personal use or records. If you make other use of the Site, except as otherwise provided above, you may violate copyright and other laws of India and may be subject to liability for such unauthorised use.

Applicable Laws

  1. We control and operate the Site from our offices in India. In all matters relating to the Site and these Terms and Conditions, the applicable law shall be the law of India. All viewers and users of the Site agree to submit to the exclusive jurisdiction of the Indian Courts.
  2. The Indian laws are applicable when using the Site. We do not represent that materials on the Site are appropriate or available for use in other locations. Persons who choose to access this Site from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable.
